Once you file your Trademark Application Australia, the process doesn’t end there. Here's what happens next.
The first step after submission is examination by IP Australia. The examiner checks your trademark for compliance with the legal requirements. This includes assessing its distinctiveness and ensuring it doesn’t conflict with other registered marks.
If your application passes the examination, it will be published in the Australian Official Journal of Trade Marks. During this period, third parties can oppose your application if they believe it conflicts with their rights.
If no opposition is raised, and your trademark is accepted, it will be registered, and you’ll receive exclusive rights to use it in Australia for ten years, with the option to renew.
